Art. 1 – General Provisions

1.1. By browsing this area, users access www.shopkosmima.com, available via the URL www.shopkosmima.com. Browsing and transmitting a purchase order on the website imply acceptance of the Terms and Data Protection Policies adopted by the site, as indicated here.

1.2. These General Conditions of Sale apply exclusively to the sale of products purchased on the website, in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code (D.lgs. no. 206/05, amended by D.lgs. no. 21/14 and D.lgs. 70/03).

1.3. Users are required to read these General Conditions of Sale before accessing the products provided by the site, as they are generally and unequivocally accepted at the time of purchase.

1.4. Users are encouraged to download and print a copy of the purchase form and these General Conditions of Sale, which www.shopkosmima.com reserves the right to modify unilaterally without notice.

1.5. The site can be accessed in the following languages: English.

Art. 2 – Object

2.1. These General Conditions of Sale govern the offer, submission, and acceptance of purchase orders for products on www.shopkosmima.com. They do not, however, govern the supply of services or the sale of products by parties other than the seller, who may be present on the same site via links, banners, or other hypertext connections.

2.2. Before placing orders and purchasing products and services from third parties, it is recommended to verify their conditions of sale.

Art. 3 – Conclusion of the Contract

3.1. To conclude the purchase contract, the form must be completed electronically and sent following the relative instructions.

3.2. The form contains a reference to the General Conditions of Sale, images of each product and its price, the available payment methods, delivery methods, and shipping costs.

3.3. Before concluding the contract, users will be asked to confirm the reading of the General Conditions of Sale, including information on the right of withdrawal and the processing of personal data.

3.4. The contract is concluded when the seller receives the form electronically, after verifying the accuracy of the data.

3.5. The user will be obliged to pay the price upon completion of the online ordering process by clicking “send” at the end of the procedure.

3.6. Once the contract is concluded, the seller will take charge of the order for its fulfillment.

Art. 4 – Registered Users

4.1. When completing the registration procedures, the user agrees to follow the instructions on the site and to provide personal information accurately and truthfully.

4.2. Once the registration is completed, the user will receive a confirmation email to the provided email address. Confirmation must be communicated within a maximum of one day. If confirmation is not received within this period, www.shopkosmima.com will be released from all obligations towards the user.

4.3. The confirmation will release www.shopkosmima.com from any liability regarding the information provided by the user. Users agree to promptly inform www.shopkosmima.com of any changes to the provided information at any time.

4.4. If the user provides incorrect or incomplete information, or if there are disputes from the relevant parties regarding payments made, www.shopkosmima.com has the right to not activate or suspend the service until the deficiencies are resolved.

4.5. During the first request for profile activation by the user, www.shopkosmima.com will assign a username and password. The user acknowledges that these credentials represent the system for validating the user’s access to the services and the only means suitable for identifying the user. The actions carried out through this access will be attributed to the user and will be legally binding.

4.6. The user agrees to maintain the confidentiality of their access data and to safeguard it with due care and diligence. The user also agrees not to share it, even temporarily, with third parties.

Art. 5 – Product Availability

5.1. Product availability refers to the actual availability at the time the user places the order. However, this availability must be considered purely indicative as, due to the simultaneous presence of several users on the site, products may be sold to other customers before the order is confirmed.

5.2. Even after sending the order confirmation email, partial or total product unavailability may occur. In such cases, the order will be automatically adjusted by removing the unavailable product, and the user will be informed immediately by email.

5.3. If the user requests to cancel the order, terminating the contract, www.shopkosmima.com will refund the amount paid within 7 business days from the moment www.shopkosmima.com becomes aware of the buyer’s decision to terminate the contract.

Art. 6 – Offered Products

6.1. www.shopkosmima.com sells jewelry, home decor, and craft items. 6.2. The offer details are listed on the website.

Art. 7 – Payment Methods and Prices

7.1. The price of the products will be the one indicated on the website, except in cases of obvious error.

7.2. In the event of an error, www.shopkosmima.com will inform the buyer as soon as possible, allowing them to confirm the order at the correct price or cancel it. In any case, www.shopkosmima.com will not be obligated to supply the product at the incorrect lower price.

7.3. The prices listed on the website include VAT. Prices can change at any time, but such changes will not affect orders for which an order confirmation has already been sent.

7.4. Shipping costs will be borne by the buyer and will vary based on the user’s shopping cart. The user will always be informed of the shipping costs during the checkout process.

7.5. Once the desired products and services have been selected, they will be added to the shopping cart. It is sufficient to follow the purchasing instructions, entering or verifying the required information at each step of the process. The details of the order can be modified before making the payment.

7.6. Payment can be made via credit or debit card. Payment information must be entered at the time of the order using a valid credit or debit card, such as Visa, Mastercard, or American Express. The amount will be charged immediately, and www.shopkosmima.com reserves the right to verify the card’s validity and its solvency status. Based on the outcome of the checks, www.shopkosmima.com reserves the right to refuse the order.

7.7. If payment is made via PayPal, www.shopkosmima.com reserves the right to verify the validity of the PayPal account, check that sufficient funds are available to cover the purchase amount, and confirm the billing address. The amount will be charged immediately from the PayPal account, but no costs will be charged until the items leave the warehouse. www.shopkosmima.com reserves the right to refuse any order.

Art. 8 – Delivery Methods

8.1. www.shopkosmima.com ships to all regions of Italy, except the Vatican City and the Republic of San Marino.

8.2. Deliveries are available worldwide.

8.3. www.shopkosmima.com will only deliver to the address provided by the user at the time of purchase.

8.4. For deliveries within Italy, the typical delivery time is 2-7 business days, or if no specific delivery date is mentioned, within the time estimated at checkout. In any case, the delivery will occur within a maximum of 30 days from the confirmation of the order.

8.5. For countries within the European Union, delivery will take about one week, and in any case, no later than 30 days.

8.6. For non-EU countries, delivery will take 10-14 days.

8.7. If delivery is not possible, the order will be sent to a designated storage location. In this case, a notification will specify where the order is located and how to arrange for a new delivery.

8.8. If the user is unable to be present at the delivery location at the agreed time, they should contact us again to arrange a new delivery date.

8.9. If delivery cannot take place for reasons beyond our control after 30 days from when the order is available for delivery, we will assume the user wishes to terminate the contract.

8.10. As a result of termination, amounts paid will be refunded, including delivery costs, excluding any additional costs resulting from a delivery method different from the standard delivery method offered. Refunds will be processed without undue delay and, in any case, within 7 business days from the date of contract termination. Additional transportation costs resulting from contract termination will be the buyer’s responsibility.

8.11. Shipping costs are the responsibility of the buyer and will be explicitly highlighted at the time of ordering.

Art. 9 – Transfer of Risk

9.1. The risks associated with the products will be transferred to the buyer at the time of delivery. Ownership of the products is considered acquired as soon as full payment of all amounts due, including shipping costs, has been received, or at the time of delivery if this occurs later.

Art. 10 – Warranty and Commercial Compliance

10.1. The seller is responsible for any defect in the products offered on the site, including the non-conformity of the items to the products ordered, according to Italian law.

10.2. If the buyer has entered into the contract as a consumer, that is, any natural person acting on the site for purposes unrelated to their business or professional activity, this warranty is valid provided that the defect appears within 24 months from the date of delivery of the products and that the buyer formally files a claim regarding the defects within a maximum of 2 months from the date the defect was acknowledged. The online return form must be correctly completed.

10.3. In case of non-conformity, the consumer will have the right to have the product’s conformity restored at no cost, by repair or replacement, or to obtain an appropriate price reduction or termination of the contract for the disputed goods and the subsequent refund of the price.

10.4. All return shipping costs for defective products will be borne by the seller.

Art. 11 – Right of Withdrawal

11.1. In accordance with current legal provisions, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days under Art. 52 of Legislative Decree 206/2005, starting from the date of receipt of the products.

11.2. In the case of multiple purchases made by the buyer in a single order and delivered separately, the 14-day period starts from the date of receipt of the last product.

11.3. The user intending to exercise the right of withdrawal can send an email indicating the order number and the user’s name to: ira@shopkosmima.com.

11.4. The buyer must exercise the right of withdrawal by sending an explicit declaration containing the decision to withdraw from the contract, or by alternatively transmitting the standard withdrawal form, as per Annex I, Part B, Legislative Decree 21/2014 (not mandatory).

11.5 The goods can be returned to any store location in Italy, as indicated on our website, or shipped to:

11.6 The goods must be returned intact, in their original packaging, complete with all parts, and accompanied by the relevant tax documentation. Subject to verification of compliance with these conditions, the website will refund the amount paid for the returned products within a maximum of 7 business days, including any shipping costs incurred by the user.

11.7 The costs incurred for returning the goods will be borne by the user.

11.8 As provided by Article 56, paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the website may withhold the refund until the goods have been received or until the user has demonstrated proof of returning the goods.

11.9 The right of withdrawal does not apply if the services or products of www.shopkosmima.com are included in the categories listed in Article 59 of Legislative Decree 206/2005.

11.10 The website will issue the refund using the same payment method chosen by the buyer at the time of purchase. In the case of payment by bank transfer, if the user exercises the right of withdrawal, they must provide the necessary bank details: IBAN, SWIFT, and BIC to facilitate the refund.

Art. 12 – Data Processing

12.1 Buyer data is processed in accordance with the applicable personal data protection regulations, as specified in the relevant section containing the information pursuant to Article 13 of EU Regulation 2016/679 (Privacy Policy).

Art. 13 – Severability Clause

13.1 In the event that any clause of these General Conditions of Sale is null and void for any reason, this will not affect the validity and enforceability of the other provisions contained in these General Conditions of Sale.

Art. 15 – Applicable Law and Jurisdiction

15.1 These General Conditions of Sale are governed by Italian law and interpreted in accordance with it, without prejudice to any overriding mandatory provisions of the buyer’s country of habitual residence. Consequently, the interpretation, performance, and termination of the General Conditions of Sale are subject exclusively to Italian law.

15.2 Any disputes related to and/or arising from these Conditions must be resolved exclusively by the Italian judicial authority. In particular, if the user qualifies as a Consumer, any disputes must be resolved by the court of the consumer’s place of domicile or residence, in accordance with applicable law.
